Terms of Use for the "Zip your Lips!" App#

1. Provider and scope#
1.1 The app "Zip your Lips!" (the "App") is provided by Pamuk und Kuscu GbR (PAKU Media), represented by its partners Aykut-Rasih Pamuk and Bünyamin Kuşcu, Friedhofstraße 171, 33659 Bielefeld, Germany, email: hello@pakumedia.de, phone: +49 521 98 99 40 99 ("we", "us"). We offer the App under our brand "PAKU Studios".
1.2 These Terms of Use govern your use of the App and its online services. You accept them by continuing on the sign-in screen (with Apple, with Google or as a guest) or by tapping "Accept" in the App's prompt.
1.3 Downloads and purchases are also subject to the terms of the Apple App Store. Section 13 contains the terms Apple requires for apps.
1.4 How we process personal data is explained in our Privacy Policy. You can find it in the App under Settings → Legal → Privacy policy.
2. The service#
2.1 "Zip your Lips!" is a party game in which teams explain, draw, act out or guess terms. Among other things, the App offers:
- Pass & Play: playing on one device;
- Online rooms: playing together on several devices via a room code, QR code or invite, with live drawing and – with the Party Pass – a live camera in Pantomime rounds;
- Social features: profiles, friend codes, friend requests, invites, online status, match history, favorites gallery;
- Custom decks: word lists you create yourself;
- Party Pass (paid): see section 5.
2.2 The basic features are free. You are not entitled to specific content, game modes or uninterrupted availability of the online services. Maintenance, technical faults or events beyond our control may temporarily limit use. We may develop the App further and change free features where this is reasonable for you. Your rights under a paid Party Pass are not affected (section 5).
3. Minimum age#
3.1 You may use Pass & Play on one device at any age. You may use an account with Apple or Google, the online features (rooms, friends, live camera) and the Party Pass from the age of 16. If you are under 16, you need the consent of your parent or guardian for them.
3.2 Purchases by minors are governed by the law and by the App Store settings (e.g. Family Sharing, "Ask to Buy").
4. Account#
4.1 Online features, match history and the Party Pass require an account. You sign in with Apple or Google, or play with a guest account. The App creates a guest account when you choose "Play as guest" and, if you are connected to the internet, also automatically when you go online, finish a Pass & Play game or want to buy the Party Pass without an account. You can later link a guest account to Apple or Google; your progress carries over.
4.2 A guest account is tied to the App on your device. If you sign out or delete the App without linking the guest account to Apple or Google, you can no longer access it. We automatically delete guest accounts that have not been used for 90 days, with all their data, unless they have an active Party Pass. You can assign a Party Pass bought through the App Store to another account using "Restore purchases".
4.3 You are responsible for activity under your account and may not share it with others.
4.4 Your display name must not violate section 6, impersonate other people, brands or us, or contain contact details. The App automatically rejects names containing clearly offensive terms.
4.5 You can delete your account in the App at any time (Settings → Account → Delete account). Deleting your account does not cancel a running subscription (section 5.6).
5. Party Pass (subscription)#
5.1 What it includes: Among other things, the Party Pass unlocks all word packs, the live camera in Pantomime rounds, and creating and playing custom decks. The App shows the exact scope before you buy.
5.2 Offers: The Party Pass is an auto-renewing subscription. The current offers are:
- Party Pass Year: €19.99 per year, with a 3-day free trial if your Apple Account is eligible;
- Party Pass Week: €3.99 per week, without a trial.
These prices apply in Germany and include VAT. Prices and currency may differ in other countries. The price, term and trial period the App Store shows you before you buy are binding.
5.3 Contract and payment: You buy the Party Pass in the App Store. The purchase contract is concluded with Apple, and Apple charges your Apple Account. Payment is due when you confirm the purchase, or at the end of the free trial if one applies. We do not receive payment data.
5.4 Free trial: The free trial automatically converts into the paid annual subscription unless you cancel at least 24 hours before it ends. Apple decides whether you are eligible for a trial (usually once per Apple Account).
5.5 Auto-renewal: The subscription automatically renews for the chosen term (one year or one week) at the then-current price unless you turn off auto-renewal at least 24 hours before the end of the current period. Your Apple Account is charged within the 24 hours before the end of the current period.
5.6 Cancellation: You cancel in your Apple Account's subscription settings (iPhone: Settings → [your name] → Subscriptions; in the App: Settings → Party Pass → Manage subscription). After cancelling, the Party Pass stays active until the end of the period you paid for. Deleting the App or your account does not cancel the subscription.
5.7 Restore purchases: "Restore purchases" (in the App under Settings → Party Pass and on the Party Pass screen) assigns an active subscription to your current account, e.g. after switching devices.
5.8 Withdrawal and refunds: Because the purchase contract is with Apple, withdrawal and refunds are governed by Apple's terms. You can request a refund at https://reportaproblem.apple.com.
5.9 Host effect: If the host of an online room has an active Party Pass, the other players can use the Party Pass features in that room for the current game. This does not give them any entitlement of their own.
5.10 Price changes follow Apple's rules. Apple informs you in advance and asks for your consent where required.
6. User content and rules of conduct – zero tolerance#
6.1 User content is any content you create or show in the App: display name, profile picture, drawings, live camera image, custom decks (names, terms, taboo words), typed guesses and names you enter for other players.
6.2 We have zero tolerance for objectionable content and abusive users. In particular, content and behavior are prohibited that
a) are insulting, hateful, discriminatory or degrading, in particular on the grounds of origin, skin color, religion, gender, sexual orientation, disability or age;
b) are sexually explicit or pornographic, show nudity or sexualize minors;
c) glorify violence, threaten others, encourage self-harm or crime, or are extremist or terrorist;
d) harass, bully, humiliate, stalk or intimidate others;
e) violate personality rights, for example by showing images or video of other people without their consent or by publishing private information;
f) infringe copyrights, trademarks or other third-party rights;
g) contain spam, advertising, scams or links to harmful content;
h) manipulate the App, for example through cheats, bots, exploiting bugs, circumventing the Party Pass, or unauthorized access to our systems or other people's accounts;
i) otherwise violate applicable law.
6.3 Live camera: Only show yourself or people who have agreed to it on camera, and nothing described in section 6.2. Recording or sharing other players' camera images without their consent is prohibited.
6.4 Responsibility and filter: You are responsible for your user content. The App automatically checks display names and custom decks for clearly offensive terms; beyond that, we do not review user content in advance. If we are notified of illegal or prohibited content, we act as described in section 7.
7. Reporting, blocking, removal and termination#
7.1 Reporting: You can report profiles, drawings, live videos and a host's custom decks directly in the App (via the menu on the player or content). You can also send notices about illegal content by email to hello@pakumedia.de. Please state as precisely as possible which content is concerned and why it is illegal.
7.2 Blocking and hiding: You can block other players. You are then no longer friends, pending requests and invites are deleted, you can no longer add or invite each other, and neither of you can join a room the other is in. One of you is removed from a shared lobby; a game already running continues until it ends. You manage blocked players in Settings. You can also hide other players' live video during a game. Hosts can remove players from their lobby.
7.3 Review: We review reports promptly, usually within 24 hours. If content violates these Terms, we remove it and take action against the person responsible under section 7.4.
7.4 Measures: If you violate section 6, we may, taking into account the severity of the violation and your legitimate interests,
- remove content or make it invisible,
- reset display names or profile pictures,
- exclude you from online features,
- suspend your account temporarily or delete it permanently.
For serious violations, in particular under section 6.2 b), c) and d), we suspend or delete the account immediately and without prior warning. We may report criminal content to the competent authorities.
7.5 Statement of reasons and appeal: We inform you of a measure and the reasons for it where the law requires and where possible. You can appeal by email to hello@pakumedia.de. We will then review the decision again.
7.6 Party Pass after suspension: A justified suspension or deletion because of a serious violation does not entitle you to a refund from us. Statutory rights and Apple's refund rules remain unaffected. In that case, cancel your subscription through Apple (section 5.6).
8. Rights to the App and to content#
8.1 License to use the App: We grant you a non-exclusive, non-transferable, revocable right to use the App for private, non-commercial purposes on Apple devices you own or control, within the App Store's usage rules. All rights to the App, its design, name and logo, and the included word packs, graphics, sounds and texts belong to us or our licensors.
8.2 Restrictions: You may not decompile, reverse engineer or modify the App, except where mandatory law permits it (Secs. 69d, 69e German Copyright Act). You may not extract, copy or use the word packs outside the App.
8.3 User content: You keep the rights to your user content. You grant us a non-exclusive, royalty-free, worldwide right to store it, process it technically (e.g. scale down, compress), transmit it and show it to other users in the App, to the extent needed to operate the App. This right ends once the content or your account is deleted. Drawings from online games remain, without any link to you, in the other participants' match history, as described in the Privacy Policy. You confirm that you are entitled to grant these rights.
9. Liability#
9.1 We are liable without limitation for intent and gross negligence, for injury to life, body or health, under the German Product Liability Act, and where we have given a guarantee.
9.2 For slightly negligent breach of a material contractual obligation (an obligation whose fulfillment makes proper performance of the contract possible in the first place and on which you may rely), our liability is limited to the typical, foreseeable damage.
9.3 Otherwise, liability for slight negligence is excluded.
9.4 We are not responsible for the content or behavior of other users. Our statutory obligations once we become aware of illegal content (section 7) remain unaffected.
9.5 These limitations also apply to our partners, employees and agents.
9.6 Statutory warranty rights for digital products (Secs. 327 et seq. German Civil Code) remain unaffected.
9.7 Note on play: Play considerately and watch your surroundings during Pantomime rounds.
10. Indemnity#
If third parties assert claims against us because you culpably posted user content or behaved in a way that violates these Terms or applicable law, you indemnify us against those claims, including reasonable legal defense costs.
11. Term and termination#
11.1 The agreement for using the free App runs for an indefinite period. You can end it at any time by deleting your account and uninstalling the App.
11.2 We may terminate the free usage agreement with four weeks' notice. The right to terminate for good cause, in particular for violations of section 6, remains unaffected. If we discontinue the App or its online services entirely, we will inform you in the App in good time, so you can cancel a running subscription. Your statutory rights for periods already paid for and Apple's refund rules remain unaffected.
12. Changes to these Terms#
12.1 We may change these Terms for a valid reason, for example new features, changes in law or case law, or to better protect users. We will not unilaterally change the main obligations of a paid Party Pass to your disadvantage.
12.2 We inform you of changes in the App. The App asks you to accept the new version before you can continue using online rooms, friends, other players' profiles or the match history. If you do not accept, you can no longer use these features and can delete your account. Pass & Play remains available.
13. Apple terms#
For the App obtained from the Apple App Store, the following also applies:
a) These Terms are concluded between you and us only, not with Apple. We, not Apple, are solely responsible for the App and its content.
b) Apple has no obligation to provide any maintenance or support services for the App.
c) If the App fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App.
d) We, not Apple, are responsible for addressing any claims relating to the App (e.g. product liability, failure to meet legal or regulatory requirements, consumer protection).
e) If a third party claims that the App infringes its intellectual property rights, we, not Apple, are responsible for investigating, defending, settling and discharging that claim.
f) You represent that you are not located in a country subject to a US government embargo or designated as a "terrorist supporting" country, and that you are not listed on any US government list of prohibited or restricted parties.
g) Apple and its subsidiaries are third-party beneficiaries of these Terms and, once you accept them, may enforce them against you.
h) You must comply with applicable third-party terms when using the App.
14. Dispute resolution#
We are neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board.
15. Governing law, jurisdiction, contact#
15.1 These Terms are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer habitually resident in another country, you keep the protection of that country's mandatory law.
15.2 If you are a merchant, a legal entity under public law or a special fund under public law, the place of jurisdiction is Bielefeld. For consumers, the statutory places of jurisdiction apply.
15.3 If any provision is invalid, the remaining provisions stay valid. The statutory provision replaces the invalid one.
