Terms of Use for the “Daytape” app#

1. Provider and scope#

The “Daytape” app is provided by Pamuk und Kuscu GbR (PAKU Media), brand “PAKU Studios”, Friedhofstraße 171, 33659 Bielefeld, Germany, email hello@pakumedia.de. These terms apply between you and us for the use of the app. The App Store terms apply in addition to downloading the app and to purchases.

2. What Daytape is#

Daytape is a private video diary. You record short moments and the app plays them back as the film of your day. There is no account, no sign-in and no community feature. Your recordings stay on your device.

3. Use and age#

The app is for users aged 13 and over. If you are a minor, you need your guardian’s consent, especially for purchases.

4. Your content and your responsibility#

Your recordings are yours. We acquire no rights to them and have no access to them. You are responsible for being allowed to make your recordings, in particular that people in frame agree and that you respect applicable law.

5. Daytape Free and Daytape Pro#

Free: unlimited recordings; the day film inside the app is shortened to 30 seconds.
Pro: the complete day film and favorite moments. Pro is available as a subscription (monthly or yearly, both with a 3-day free trial) or as a one-time purchase (“Lifetime”).
Prices are shown in the App Store before you buy.
Subscriptions renew automatically until you cancel. Cancel in the iOS settings under Subscriptions, at the latest 24 hours before the current period ends.
Apple handles purchases and refunds. Request a refund at https://reportaproblem.apple.com.
Days you recorded while Pro was active keep their complete day film even after the subscription ends.

6. Right of withdrawal#

For digital content, your right of withdrawal expires once performance begins immediately with your express consent. Independently of this, you can ask Apple for a refund.

7. Availability and changes#

We keep developing the app and may change or discontinue features. We announce significant changes in the app or on this page. There is no claim to any particular feature.

8. Backups#

Your recordings live only on your device and are excluded from the iCloud backup. If you delete the app or lose your device, the recordings are gone. Export the films you want to keep to your Photos library. We cannot restore recordings.

9. Liability#

We are liable without limitation for intent and gross negligence, under the German Product Liability Act, and for injury to life, body or health. For ordinary negligence we are liable only for the breach of an essential contractual duty, limited to the foreseeable damage typical for this type of contract. Any further liability is excluded.

10. Final provisions#

German law applies; mandatory consumer protection rules of your country of residence remain unaffected. If a provision is invalid, the rest remains valid.
