Terms of Use for the “Daytape” app#

1. Provider and scope#

The “Daytape” app is provided by Pamuk und Kuscu GbR (PAKU Media), brand “PAKU Studios”, Friedhofstraße 171, 33659 Bielefeld, Germany, email hello@pakumedia.de. These terms apply between you and us for the use of the app. The App Store terms apply in addition to downloading the app and to purchases. The app is licensed to you under Apple’s standard license agreement (Standard EULA, https://www.apple.com/legal/internet-services/itunes/dev/stdeula/). These terms supplement it; where they differ, these terms take precedence. Mandatory consumer rights remain unaffected.

2. What Daytape is#

Daytape is a private video diary. You record short moments and the app plays them back as the film of your day. There is no account, no sign-in and no community feature. Your recordings stay with you: from version 1.1 in your Photos library in the album “Daytape” (recording needs access to Photos), clips from version 1.0 on your device inside the app.

3. Use and age#

The app is for users aged 13 and over. If you are a minor, you need your guardian’s consent, especially for purchases.

4. Your content and your responsibility#

Your recordings are yours. We acquire no rights to them and have no access to them. You are responsible for being allowed to make your recordings, in particular that people in frame agree and that you respect applicable law.

5. Daytape Free and Daytape Pro#

Free: unlimited recordings; the day film plays in full in the app, and the first minute can be exported; trim up to 30 seconds per day; up to 3 favorite moments; from version 1.6 up to 5 photos per day in the day film, search, app lock and your own end of day. What is included in Free stays free: we never move a Free feature to Pro later and never tighten a Free limit.
Pro: the complete day film as an export, unlimited trimming, unlimited favorite moments, titles for clips and your own photos as day covers, recording in 4K (from version 1.5.3), and from version 1.6 places on clips (also added automatically) and unlimited photos per day. Pro is available as a subscription (monthly or yearly, both with a 7-day free trial) or as a one-time purchase (“Lifetime”).
Prices are shown in the App Store before you buy.
Subscriptions renew automatically until you cancel. Cancel in the iOS settings under Subscriptions, at the latest 24 hours before the current period ends.
Apple handles purchases and refunds, see section 6.
Days you recorded while Pro was active keep their complete export even after the subscription ends.

6. Right of withdrawal#

You buy Daytape Pro in the App Store. The seller is Apple (in the EU, Apple Distribution International Ltd.). Apple’s terms and Apple’s notice on the right of withdrawal apply to withdrawal and refunds; request a refund at https://reportaproblem.apple.com.

7. Availability and changes#

We keep developing the app and may change or discontinue features. We announce significant changes in the app or on this page. We change Daytape Pro features only for technical or legal reasons, or when we discontinue a feature and have announced this at least 30 days in advance.

8. Backups#

From version 1.1 your clips live in your Photos library. They are backed up by your photo service, for example iCloud Photos, if you use it; we have no influence on that. The details of your days and your profile picture are part of your device backup.

If you delete clips in Photos while the day is still running, they are missing from the day film. Clips that still live in the app (from version 1.0) are excluded from the backup: if you delete the app or lose your device, they are gone. Move them to Photos from the profile or export the films you want to keep. We cannot restore recordings.

9. Liability#

We are liable without limitation for intent and gross negligence, under the German Product Liability Act, and for injury to life, body or health. For ordinary negligence we are liable only for the breach of essential contractual duties (i.e. obligations whose fulfilment is essential for the proper performance of the contract and on which you may regularly rely), limited to the foreseeable damage typical for this type of contract. Any further liability is excluded.

10. Final provisions#

German law applies; mandatory consumer protection rules of your country of residence remain unaffected. If a provision is invalid, the rest remains valid.

We are neither obliged nor willing to take part in dispute resolution proceedings before a consumer arbitration board.
